anyway back to the tresspass/access - its fair to say if your not flattening crops, walls - sheep/cattle worrying (!) and are tidy - its fair enough to reach the shore to gain access to below the highwater mark

and if the chance arises give a nod to the landowner - youve probably been trapsing long enough to find the mark dont mind looking for the auld codger whos land it is

Hello all.
I know bugger all about the law on this but I fish a lot of marks that can only be accessed via farm land. I always seek out the land owner and ask for permission and have to date never been refused.
A smile on your mug and a bit of manners goes a long way.

Am I correct in thinking that trespass must include some element of damage to the property or anti-social behaviour, and that as such anyone walking across a field of grass (not a grain crop etc.) can not be accused of trespass? Not an issue around here as it is mostly bog!

If you walk across a farmer's field, and there is not a right of way established, he can direct you to leave.

I ahd a brief chat with someone who is a solicitor. Basically there is no right to roam in Ireland, so unless there is an established right of way you may be trespassing.
I'd seek out the position of the lanmdowner where possible.
