IT help with fishing blog.

Postby JimH » Mon Jan 19, 2015 9:05 pm

If anyone can help me with this crap here http://www.probassfisher.com/about-me/ - (basically a complete replica of 'Probassfisher' sitting on a .com domain name) I would be eternally grateful.

It really gets to me. (OCD)

Professional advice gladly accepted and reimbursed.
Thanks
Jim

I guess you've already googled for something like : someone cloned my website

According to that :
http://www.ukbusinessforums.co.uk/threa ... te.328979/

it should be doable to contact the ISP to shut down the clone because it is hosted in the US. You may also need to contact Google or the other search engines to try to get back your rank.

Hi Jim,
due the fact they are stealing your info and trying to replicate your site you have a case. I can see that the site is registered with GoDaddy.
Send an E-Mail to abuse@godaddy.com with screenshots of the replicated info!

Domain Name: PROBASSFISHER.COM
Registrar URL: http://www.godaddy.com
Registrant Name: Marna Barney
Registrant Organization:
Name Server: ALL1.DNSROUNDROBIN.NET
Name Server: ALL2.DNSROUNDROBIN.NET
DNSSEC: unsigned

For complete domain details go to:
http://who.godaddy.com/whoischeck.aspx? ... FISHER.COM

Information Updated: Tue, 3 Feb 2015 16:29:41 UTC

Alternatively you can contact webhostireland who is hosting your website/DNS record and see what they can do for you.
This is where I would start off. They would have direct connections to godaddy.

If they manage to suspend the DNS Record I would get hostireland to reserve it for you also. This may cost you a bit extra!

Good luck.

Hi Jim,

I took a good look at the site today and have a few helpful solutions i hope.
When you contact godaddy, inform them there is illegal use of personal and private information by this site.
This site is using phone numbers and house addresses belonging to you or others.
The internet is full of copy and paste type sites taking from others, you may not be able to get all your work removed but you can have numbers and personal information or photos removed.

There are a few reasons this person has set the site up like this-
1: They may be generally interested in bass fishing, perhaps a stress free method is direct contact with them and nicely ask them if they could take your hard work down off their site and perhaps say you could help them when making their own.

2: This person could be a site flipper, this is a person who buys a site with the view of increasing their investment multiple times. They may buy the site for 10 and sell for 100.

3: A way to look at this so far is this is free advertisement for your business, it would be interesting to see what the traffic information is for this site.

"When a person browses a website, and by so doing displays the [copyrighted] Handbook, a copy of the Handbook is made in the computer's random access memory (RAM), to permit viewing of the material. And in making a copy, even a temporary one, the person who browsed infringes the copyright. Additionally, a person making a printout or re-posting a copy of the Handbook on another website would infringe plaintiff's copyright."

This may also give you helpful info.

TheHero

Sorry guy dont know your name - many thanks for help with this. The problem I guess i'm having is that there's a LOT of work involved here to see this through. Plus it appears to be a minefield of dead ends and 'interpretations' . At the moment I don't have this time but would love to be rid of the other site.

Even though I have stopped guiding at this time I would like to avoid the confusion as regards the site that this has caused for many people. I cant just leave it the way it is and too much work has gone into it to disregard it.

If you know of any professional services that may specialize in this kind of thing I'm all ears.

Plus like above, if your ever in Wexford or would like to meet to fish and chat, my brother lives in Middleton and we often fish together....

Thanks
Jim

Back with some more info, hope it helps.

This is the digital law DCMA - http://www.copyright.gov/reports/studies/dmca/dmca_executive.html

On further checking of that site i found it has had irish bass pages on it since 2009, was this site taken by someone else?
This site has a footprint back to 2009 using irish sites informtion or was once owned by an irish person. https://web.archive.org/web/*/http://probassfisher.com

What steps can I take if someone is using my site content?

Use the information on the contact page as your starting point. If there is no contact information, look at the footer section for a web master address or hosting company. Send a nice message requesting that the content be removed and where the original copy is located. Some site owners don’t know the content is plagiarized and are the unknowing victim of an unscrupulous copywriter in their own marketing department.

In my experience, this first email usually takes care of the problem. Sometimes an apology email is received and sometimes the content just disappears from the site. Remember to follow up after the first email is sent and even a few months later to make sure your copy does not reappear.

If that doesn’t work, type in the domain name at Whois.com. The owner’s name and phone number should appear in their records. Contact the website owner directly to request immediate removal of the plagiarized content.

If that fails, inform the site’s hosting company of their client’s copyright infringement. Hosting company information is found on the Whois site under the domain registration information or sometimes on the site itself. Once it is confirmed that the content is in violation, some hosting companies will remove the site immediately.

Still no response? You may consider mailing a formal “Cease and Desist” letter. Your attorney can assist you with the appropriate format since the wording may affect your rights if it goes to court or you can search the web for examples. Send it certified mail.

A possible last resort? Exercise your rights under the Digital Millennium Copyright Act (DMCA). You can go directly to the major search engines like Google and Yahoo with your copyright infringement complaints.

I didn’t legally register my web site copy. Do I still have copyright protection?

Whether you filed the registration paperwork or not, your site copy is still protected by copyright laws. Copyright protection begins at the moment of creation in a tangible medium and whether it’s published or unpublished.
