Bass are a slow growing species.
Bass become sexually mature when they grow to about 40cms.
People are allowed to kill bass when they are 40cms or over.

ye makes sense to me ye cant kill juivenille bass give them a chance to reach spawning age.

im sure he means why not let dem grow 2 45cm before we keep dem or bigger.
if der only getin 2 age 2 spawn and dont get chance 2 cos ie... its my dinner

I think the reasoning is that if the MLS is 40cm, then they only have to survive perhaps another season before spawning. Whereas with a MLS of, say 36cm, they might have to survive 2 or 3 more seasons.
i.e. the MLS of 40cm doesn't give them a 100% chance of avoiding capture before spawning, but it does give them a better chance than they would otherwise have.
But I agree, a mls of 45 or even 42 would seem to make more sense and make very little difference from my point of view as an angler.

whats the problem here, common sence prevails, take 1 or 2 a year over the minimum size but under 50 or so, and put the rest back

I think anthony2carr was just wondering what logic led someone to arrive at a figure of 40cm, from a legislative point of view.
No one's suggesting that you can't apply common sense, independently of the law. ;) After all, bungee jumping isn't illegal, but you won't find me doing it :D
