New Sea Trout Bye law#834-2008

Just a note on a new bye law in relation to sea trout.


DEPARTMENT OF COMMUNICATIONS, ENERGY AND NATURAL RESOURCES
FISHERIES ACTS 1959 TO 2006
CONSERVATION OF SEA TROUT BYE-LAW NO. 834, 2008.

I, Eamon Ryan, Minister for Communications, Energy and Natural Resources, in exercise of the powers conferred on me by section 9 (as amended by section 3 of the Fisheries (Amendment) Act 1962 (No. 31 of 1962)) of the Fisheries (Consolidation) Act 1959 (No. 14 of 1959), section 33 of the Fisheries (Amendment) Act 1962, the Fisheries (Transfer of Departmental Administration and Ministerial Functions) Order 1977 (S.I. No. 30 of 1977) (as adapted by the Communications, Marine and Natural Resources (Alteration of Name of Department and Title of Minister) Order 2007 (S.I. No. 706 of 2007)) and having complied with the requirements of Regulation 31 of the European Communities (Natural Habitats) Regulations 1997 (S.I. No. 94 of 1997), hereby make the following bye-law:


1. This Bye-law may be cited as the Conservation of Sea Trout
Bye-law No. 834, 2008.


2. This Bye-law comes into operation on the day of its making.


3. In this Bye-law "sea trout" means the migratory form of salmo trutta L.


4. This Bye-law applies to the waters of the following fishery districts -

(a) the No. 91 or Galway District,

(b) the No. 92 or Connemara District,

(c) the No. 101 or Ballinakill District, and

(d) that part of the sea within the No. 102 or Bangor District south of a line drawn due east and west through the most westerly point of Achill Head situated in the townland of Keel West, Achill Island in the county of Mayo and all waters discharging into it.


5. Notwithstanding anything contained in any bye-law, it is prohibited for any person to take a sea trout by means of any fishing engine or rod and line in the waters of the fishery district to which this Bye-law applies unless the sea trout is handled carefully and immediately returned alive to the waters from which it is taken.


6. It is prohibited for any person to have in his or her possession or control on or near the waters of the fishery districts to which this Bye-law applies any sea trout which is not alive taken from those waters.

In case anyone is wondering, this is just the renewal of the existing byelaw that was out of date this year.
As you were!

I beg to differ

1) This by law is new and is specifically targeting Sea Trout and should not be confused with the Conservation of Salmon & sea trout Bye Law# 830 2007, which has been renewed this year under Conservation Measures for the Management of the Wild Salmon Fishery in 2008

2) Please note this bye law is to cover sea angling and fresh water angling.

The problem has been that sea trout have been protected in fresh water but the this protection has not been renewed at sea in a few years.

Also the Conservation of Salmon & sea trout Bye Law# 829 2007, did not mention any protection of Sea Trout at sea.

8 No. 91 Galway District.

The area comprising—

(a) the whole of the sea and the tideway along the coast between the following points, viz., Hag's Head, county Clare, and the sea point of the boundary between the townlands of Keeraunnagark South and Banraghbaun South, county Galway, and around any island or rocks of the coast between the said points, and

(b) the whole of the several river, lakes and their tributaries flowing into the tideway between the said points, and the land drained thereby.
The "A" Tidal Electoral Division of the Galway District. All the waters (except the freshwater portions thereof) comprised in the Galway District Four.
The "B" Freshwater Electoral Division of the Galway District All the freshwater portions of the waters comprised in the Galway District. Four.
9 No. 92 Connemara District

The area comprising—

(a) the whole of the sea and the tideway along the coast between the following points, viz., the sea point of the boundary between the townlands of Keeraunna gark South and Banraghbaun South, county Galway and Slyne Head, county Galway, and around any islands or rocks off the coast between the said points, and

(b) the whole of the several rivers, lakes and their tributaries flowing into the tideway between the said points, and the land drained thereby.
The "A" Tidal Electoral Division of the Connemara District. All the waters (except the freshwater portions thereof) comprised in the Connemara District. Four.
The "B" Freshwater Electoral Division of the Connemara District. All the freshwater portions of the waters comprised in the Connemara District. Four.
10 No. 101 Ballinakill District

The area comprising—

(a) the whole of the sea and the tideway along the coast between the following points, viz., Slyne Head, county Galway and Pigeon Point near Westport, county Mayo, and around any islands or rocks off the coast between the said points, and

(b) the whole of the several rivers, lakes and their tributaries flowing into the tideway between the said points, and the land drained thereby.
The "A" Tidal Electoral Division of the Ballinakill District All the waters (except the freshwater portions thereof) comprised in the Ballinakill District Four.
The "B" freshwater Electoral Division of the Ballinakill District. All the freshwater portions of the waters comprised in the Ballinakill District. Four.
11 No. 102 Bangor District.

The area comprising—

(a) the whole of the sea and the tideway along the coast between the following points, viz., Pigeon Point, near Westport, county Mayo and Benwee Head, County Mayo, and around any islands or rocks off the coast between the said points, and

(b) the whole of the several rivers, lakes and their tributaries flowing into the tideway between the said points, and the land drained thereby.

im confused. in regards to this part

does this mean i cant fish for sea trout at all, or does it mean i can only fish catch and release(providing i have a licence, of course)?

im assuming it means i can fish C+R but i have to check.

it means if you have a licence you can fish for them but are not permitted to remove them from the waters they have been caught..
in other words, strictly catch and release with no harm to the fish

due to the fact that bass and seatrout frequent the same esturine habitat how would a fisheries officer decide if you where spinning for one or tuther :?:me being a bassaholic and not interested in trout (too many bones :lol: )

why is this law only in these areas?

Working on it! :D

My own personal opinion would be it should cover all Ireland, Although our friends in Currane might have different view. Catch and release should be practice everywhere.

Seat trout need protection, that is why the WRFB pushed to get the West Coast covered especially where Salmon farms are :evil: .
