Is there any way of these "rights" being returned to the Irish state.

Yes is the simple answer, I have questioned our remaining in the EU and our withdrawal from the CFP o. Look at the Common Fisheries Policy for yourself and see how it in no way benefits the people of Ireland or UK.

When we joined the EU our fisheries where sold down the river for the agricultural sector. It still amazes though a that a British Duke has fishing rights in 2013.

I agree with you so far as I reckon the CFP is not fit for purpose and needs reforming, root and branch.

However, to explore your stance that we'd be better managers of our own Fisheries - I doubt it. They'd be just as pillaged and plundered as they are now. I wouldn't trust the civil servants to run a bath, the politicans to see past where the next vote is coming from, the commercials past the next payday or the scientists past their laboratory doors.

Just wondering, seen as mussels are filter feeders and with raw sewage and effluient from the dump entering the harbour these mussels must be full of ecoli and god knows what amount of toxins it wasnt so long ago when they stopped swimming at the front strand because of the ecoli in the water. It would be interesting to test these mussels and if they have toxins or ecoli he might have to stop if a bit of noise was made about them.

I'm no expert on the matter but mussels when harvested are put through a rigorous multi-stage filtration process to cleanse them of any toxins...

....... just a stray thought, passing through my brain.......... if this Duke fellow owns the fishing rights to that stretch of water, should anglers even be fishing there without his permission?

I was told the duke is looking at getting payment for all the boats in Youghal that have moorings..,
He will have a hard job trying to get a Penney off me..

Seems there was similar feelings regarding salmon fishing rights upstream which got very heated a few years back same ownership scenario. Isnt it just pure ridiculous that a guy can pull out ownership documents issued back pre- victorian times by a foreign monarch as a pat on the back to a nobleman from again,a foreign country. This document still has legal standing today afaik. Its almost monty pythonesque. Its actually embarassing to think of this and we are meant to be a Republic

I for one won't ever be asking any duke for permission. If if the dukes men have a problem with that they can ask me boll*x.

A bit harsh,on blaming civil servants again ,i mean what has my wife a teacher,my two sisters who are nurses have to do with managing /protecting our remaining fish stocks.Don't paint all with the same brush.

For clarity, I was referring to the civil servants in the Dept responsible for our fisheries, not teachers, nurses or any other civil servant unconnected to the issues.

another thought - what if (the infamous words :)) someone (or more people if you like) falls (or fall) ill after consuming these mussels from the Duke's water? Has the dredging to be halted until the cause is identified for health and safety reasons? Who can be held responsible for damages? The license giver or the licensee? Or is it down to the shops and restaurants? I can see lots of legal cases unfold... ;) containing problems over problems for the Duke, which he surely doesn't want to get involved in - anyway, as I said, just a thought crossing my mind.

I think that the duke had rights over the salmon fishing only & presumably trout. Commercial fishermen as far as Ardmore had to pay a licence to him.

He had & has no right to charge for any other type of fishing.

The fishing rights have been challenged in the courts I think Milo O'Shea took a case a few years ago against Cavendish but as far as I remember he lost the case, oh yeah and get this he also claims to own the river bed as well  if I find a link I'll post it.

Very interesting Declan. I suppose that the boat dredging the mussels is giving him a nice bit of money. Imagine being worth €800,000,000 and still collecting more money.

If he had any decency he would make sure to preserve the river in pristine condition.
