This may be a misleading price indication, consumer should contact the Office with details. However, the consumer does not have an automatic right to the product at the lower price. A price indication on a product is what's called an "invitation to treat";

If the consumer is advised of the correct price before purchasing, they are not entitled to the goods at the lower price. In this case, the consumer has a choice of rejecting the goods and not buying them, or, accepting the higher price and making the purchase.
If the consumer was not informed of the correct price before purchasing, they may be entitled to some form of redress from the shop for having been misled. But, if the shop refuses, as well as this Office following up on the matter, the consumer could consider taking the matter further thorough the shop's Head Office (if it is a member of a chain), or, through the Small Claims Court.

Not entirely clear as being in the retail trade myself I distinctly remember reading in one of the trade mags, there being several cases of (forecourt stores I think it was) in the recent past being fined over providing misleading information ie charging higher than displayed prices. But according to this site I stand corrected.

In relation to UK fishing tackle, I have dealt with them myself on several occasions and had a problem with an item which was duly replaced with no problems. On another occasion the item ordered was out of stock and I had to wait a couple of weeks for it, when it did arrive it arrived with a couple of packs of freebies with it to compensate.

Ebay is however a pain in the proverbials when you do have a problem, there are suppliers out there that just take the p.ss. The whole feedback set up is wrong, dodgy suppliers leave retaliatory feedback for customers who are unhappy. At the end of the day, if you have bought and paid for your item within a reasonable timeframe then the only option for sellers should be good feedback, your side of the bargain has been fulfilled.

Sorry to hear of your trouble Jude, you must have caught that guy on a bad day. That is ridiculous money he was quoting to send a beach shelter. I had a 14kg inflatable kayak delivered from Germany for €30.00 by a europe wide company called GLS. Maybe this guy should have a look at their rates.

For one final parting shot with this guy who has behaved totally unreasonably, and to make you feel better, I suggest sending him an email with a link to this post recommending he take a look at how many people have viewed it. Bad feedback indeed. As I said I had no problems dealing with them but on the info provided I wont be dealing with them again. Dont delete your emails you received from him by the way, dont want any silly libel cases... :lol:

I have been considering sending him an email with a link to the site but I think I will wait until the matter is cleared up with ebay.

I also got a price from TNT for shippig the parcel he described from his area - £15 tops. I could easily arrange to have it picked up from him but the whole incident has left a bad taste so I won't bother now.

I have done bisness with them before and had no probs tho it was small stuff now that I know what there policy is on big things I will boy cot them and I would advise every one to do the same its the only way when they see that there losing bisness then they might wise up maybe not

It is the persons decision if they want to do business with this ebay seller, I just felt that you guys should know about this in case you get stung as well.

No-one likes to be let down, especially on something you were looking forward to :( :(

I see it simply - if the say shipping to UK is a quid then thats the price. If he said shipping to UK excluding NI is a quid then thats the price. If he says shipping to the UK is a quid withan additional charge of a quid then thats the price.

You cannot be a mail order service with his amount of trades on ebay and NOT know that the particular carrier he uses charges extra for UK plus NI.

Half the problem is that the insular English think that the UK is England and a few Welsh & Scots thown in. I lived there for 20 years and many UK subjects have not got a clue about the political nomenclature of the British Isles :D

So I reckon he was either sloppy, lazy or plain ignorant of geography. Either way you were right and not he.

I know in the south if you pick up a tv and it has a cost of 10euro on it and you go to the till and the teller makes the sale, then it's a done deal nobody can stop you after that. But if the teller tells you hey thats got the wrong price on it the store does not have to sell it to you.(diffrent story if they advertise it at this price)



The way i see it is when the auction ended the deal was sealed.
You did not break any of the pre auction rules set out. ie only ship to uk.

So this constitues a sale. you won. he must obey his obligation to ship for the price agreed including pre agreed shipping cost.

I wonder if he sold a item way too cheap on ebay could he decide not to sell it to you.no way. I believe this is the same thing.

"Here's my 2 cents worth on this seller and this issue. I had EXACTLY the same issue with this seller some time ago (shipping to NI) and let them off lightly. Seems they haven't learned. Same bull about shipping charges which I proved to them. I didn't leave negative feedback guess I should have.

If I remember well when making a purchase off Ebay it has a screen saying that you are entering into a legaly binding contract to buy. AFAIK a contract works two ways.

Since this seller had this issue explained to them by me - see item 7199764845 I reckon they should be reported to Ebay. Again. I did it when they refused to ship to me and offered to refund my Paypal payment by cheque - I refused per Ebay/Paypal instructions on avoiding fraud (all they'd have had to do was cancel the check and I'd be up a gum tree)

My advice - avoid this seller like the plague.

Ebay is an absolute godsend but like everything mistakes do happen. No big deal at all. Ebay has saved me hundreds and i have yet to encounter one problem using it. And i have dealt with over 30 transactions by now...
